Leave of Absence and Holidays in Term Time
At Bosley St Mary’s CE Primary School, we know how important time together as a family is. However, we are legally required to follow the Department for Education (DfE) guidance, which makes clear that leave of absence during term time can only be granted in the most exceptional circumstances.
Parents have a duty under the Education Act 1996 to ensure their child attends school regularly.
Headteachers may not authorise term-time holidays unless the reason is truly exceptional.

What counts as an exceptional circumstance
Authorised absence may be considered for:
Armed forces or emergency services leave
A serious family crisis or bereavement
Religious observance
Attendance at a close family funeral
Adoption or court-directed meetings
Any other truly exceptional circumstance at the discretion of the Headteacher (evidence may be requested)
What will not be authorised
Absence will not normally be authorised for:
Family holidays (including those attached to school breaks)
Birthdays or family days out
“Trips of a lifetime” or surprise breaks
Work-related restrictions or poor weather elsewhere
How to request leave
Complete a Leave of Absence Request Form – available from the school office or to download below.
Submit the form at least two weeks before the planned absence.
You will receive a written response from the Headteacher confirming whether your request has been authorised.
If a holiday or absence goes ahead without authorisation, it will be recorded as unauthorised.
Fixed Penalty Notices
If a child has 10 or more unauthorised sessions (5 school days), the school may refer the matter to the Local Authority, which can issue a Fixed Penalty Notice to each parent.
The fine is:
£80 per parent if paid within 21 days
£160 per parent if paid within 28 days
If payment is not made within 28 days, the matter may proceed to the Magistrates’ Court.
